Elder Law, Medicaid Planning and Guardianships

With special focus on Medicaid planning and guardianships, Mignanelli & Associates, Ltd. provides sound and compassionate counsel to clients regarding elder law issues.  We also offer experienced representation to clients seeking to establish a guardianship.

Important Elements of Medicaid Planning and Eligibility

In some circumstances an experienced elder law attorney can advise clients regarding qualifying for long-term care benefits without depleting all of their assets.  Each client’s circumstances in this regard is very unique and must be addressed as a very individualized plan.

Guardianships

We offer experienced representation to clients who seek to establish guardianship for a loved one.  The Probate Court can appoint a guardian to make medical or financial decisions when a loved one is no longer physically or mentally competent to make these decisions for themselves and for minors.

The Probate Court has the legal authority to appoint a guardian to make decisions concerning a loved one’s person or over the loved one’s finances.  The extent of the guardian’s authority is decided by the Court, and can be all encompassing or quite limited, depending on the specific health, welfare and financial needs of the person.

The decision regarding the possible need for a guardianship can be an emotional and even a divisive issue in a family.  We can help you understand the benefits and some of the issues that may arise in a guardianship proceeding and assist you with your ongoing responsibilities once you are appointed to serve as guardian.  Those responsibilities continue for the life of your loved one or until it can be demonstrated to the Probate Court that the individual no longer needs the assistance of a guardian.

Advanced Health Care Directives

In addition to guidance on Medicaid planning and guardianships, our firm also offers comprehensive estate planning services.  We can assist you in drafting effective and clear advance health care directives and health care powers of attorney that allow you to specify who will make health care decisions for you in the event that you cannot.
